Article 1 : Preamble
These regulations have been drawn up in accordance with the provisions of articles L.6352-3 and L.6352-4 and R.6352-1 to R.6352-15 of the French Labour Code. They apply to all employees present in the company, temporary workers and trainees, as well as to any person performing work in the company, regardless of whether or not they have an employment contract with the company.
Article 2: Health and safety
Preventing the risk of accidents and illness is imperative and requires everyone to comply fully with all applicable health and safety regulations.
When training takes place on the company's site, the general and specific safety instructions applicable are those of the company.
Article 3 : Discipline et sanctions
The prevention of accidents and illness is imperative and requires everyone to comply fully with all applicable health and safety regulations. Any refusal to comply with any of the above provisions may result in disciplinary proceedings and a penalty ranging from a simple warning to dismissal.
For training courses given on the premises of the Nuances Academy, any behaviour considered to be misconduct by the management, depending on its nature and seriousness, may be subject to one or other of the following sanctions in ascending order of importance:
- Written warning from the Director of the training organisation
- Reprimand
- Permanent exclusion from the course
For staff working on the premises, any outings during working hours must be exceptional and must be authorised by the person's line manager. Any unauthorised absence constitutes misconduct and may result in disciplinary action.
Any sanction will be subject to a prior procedure in compliance with employment legislation. During the interview, the employee may be assisted by a person of his choice from the company's staff or from the list of employee advisers in the department. During the interview, the reason for the proposed sanction is indicated to the trainee, who is then given the opportunity to provide any explanation or justification for the acts of which he or she is accused. No penalty may be imposed on the employee without the latter being informed in writing beforehand.
When a temporary exclusion with immediate effect is considered essential by the training organisation, no definitive sanction relating to the misconduct at the origin of this exclusion may be taken without the trainee having first been informed of the grievances against him and, if applicable, having been summoned to an interview and having been given the opportunity to explain himself before a Disciplinary Committee.
The penalty may not be imposed less than one clear day or more than 15 days after the interview or, where applicable, after the Disciplinary Committee has given its opinion.
The trainee will be notified of the penalty in writing, stating the reasons, by registered letter or by letter delivered against receipt. At the same time, the training organisation will inform the employer and, if applicable, the joint body paying the training costs, of the sanction imposed.
Article 4 : Moral and sexual harassment
No employee may be subjected to repeated acts of moral or sexual harassment, the purpose or effect of which is to worsen working conditions likely to infringe his or her rights and dignity, to alter his or her physical or mental health or to compromise his or her professional future.
No employee may be punished, dismissed or subjected to any direct or indirect discriminatory measure, in particular with regard to remuneration, training, reclassification, assignment, qualification, classification, professional promotion, transfer or renewal of contract, for having suffered or refused to suffer repeated acts of moral or sexual harassment.
Any employee who has engaged in moral or sexual harassment is liable to disciplinary action. The employer shall take all necessary steps to prevent harassment.
Article 5: Working conditions
Office hours are Monday, Tuesday, Thursday and Friday from 9.00 am to 12.30 pm.
For staff working on site, all outings during working hours must be authorised by their line manager.
Similarly, any lateness or absence must be reported and justified to the line manager.
Employees are required to dress neatly and appropriately when carrying out their duties.
Article 6: Acknowledgement of the rules
A copy of these rules is posted on the organisation's premises and is available on the www.profilsnuances.fr website.
They apply when the training takes place on the premises of the Nuances Academy.
When the training takes place on premises made available by the customer, the internal rules of the establishment hosting the training apply.
Annex following CORONAVIRUS
In the current context, and in view of the spread of the new coronavirus (Covid-19), the Nuances Academy has put in place an exceptional plan, the aim of which is to define all the necessary measures to be applied for the protection of our beneficiaries. These measures may be modified in the light of future regulatory developments. Our activities help to limit the spread of viruses (air treatment, cleaning, hygiene measures, etc.). Given the current state of scientific knowledge about the coronavirus, we have reinforced certain measures.
1. Reminder of hygiene rules
The following hygiene rules are considered essential by the health authorities to avoid any spread of the virus and to protect the health of our beneficiaries and employees. These measures are regularly reminded:
- You must wear a mask in the office during each interview.
- Respect the social distance of at least 1 metre between each person.
- Wash your hands very regularly with soap or hydro-alcoholic gel/solution, especially when in contact with other people or objects recently handled by other people. Wash your hands before and after eating, drinking and smoking.
- Cough or sneeze into your elbow.
- Greet without shaking hands or hugging.
- Use single-use tissues and dispose of them in a bin after use.
- Use pens to avoid manipulation.
- If you have to handle the computer or documents in succession as part of the training, the beneficiary and the consultant should wash their hands before and after each use.
- Wash your hands with hydroalcoholic gel before and after signinǵ the attendance sheet.

- Wear a mask in communal areas on all our sites.
- Respect the direction of traffic in the corridors and communal areas.
- Respect the number of people allowed in the toilets.
3. Office layout
- Post sanitary instructions at reception and in offices.
- Direction of movement in corridors and common areas.
- Regular disinfection of doors, desks and equipment.
- Provision of hydro-alcoholic gel in all offices.
4. Penalties
Failure to comply with health regulations may result in disciplinary action.
